However, owning a motorcycle can not be banned. They can say you can't park it outside and stuff but they can't tell you that you can't own/ride one.
You're right, they can't prevent you from owning a motorcycle, but they CAN prevent you from operating it on the streets in their neighborhood. It will come down to "keep it in storage and go there to ride it/store it, or live somewhere else."

So your saying they can legally force him to sell his motorcycle?

No, they can't force him to sell his motorcycle. But they can (and have for less) force forclosure on the house if he doesn't either sell the bike, or keep it somewhere else. And you'll lose a hell of a lot more money (and credit) having a house forclosed on you than you will storing a bike in a shed somewhere off-property, or just selling it.

i dont see how they can control what vehicels you own tho.

No, they're not public streets. HOA's on private subdivisions are private roads. The development company purchases the land and paves their own roadage, they just have to get it all approved by the county/city. HOA's have authority over every inch of property covered by their development, and when you buy the house you're required to sign the HOA agreement saying that their decisions are legally binding, and failure to abide can result in forced forclosure/eviction, even if you own the house outright.

As for vehicles...they can't control what you own, but they can control what you keep and operate inside the development. They can't make you get rid of them physically, but they can take your house if you don't.

HOA's are the absolute ultimate form of Socialism. That's where Obama wants to take the government, BTW. But I digress (drastically).

Must be a local thing there, I've NEVER heard of streets in a neighborhood that didn't belong to the public.
I dunno man...in Florida, public roads are marked with a green street sign and private roads are marked with a blue street sign, and most gated HOA's are all private roads. Either way, it's not technically "you can't drive on our roads"...the roads have nothing to do with it. If they don't like the way you friggin walk down the sidewalk they can ban it. If they find that it's a nuisance they can ban it on grounds of said nuisance, it has nothing to do with the overall legality of operating said vehicle on said road.

I think the point of some of the posts, like Skywalker's, is that the streets in the HOA neighborhood are not necessarily public streets.
Sort of. That's an aspect of it that would give the HOA authority to do what they want without using loopholes and ruses. But in the rare cases where the streets do fall under city control and specifically outside of HOA control, they can simply omit the streets all together and say that said vehicles are a nuisance to the neighborhood, said vehicles being seen and heard are what that nuisance consists of, and therefore are not allowed to be seen or heard within the confines of the HOA's authority.

I don't understand why people are so shocked. Any organization powerful enough to give you whatever you want and need is powerful enough to take everything you have. And oh, the levels that's applicable to. lol

Just like anything. Give someone a little bit of power and they run amok. Sorta like when Skywalker was named moderator. :D

as much as i agree(or want to) thats not totally true either.
with our homes(property) in view of the public, we HAVE(by law) keep it from being an eyesore. i know that here, theres a law about keeping the lawn maintained. and you cant have broken down vehicles, etc etc...

i OWN(buying) my home. and im not allowed to park on my lawn!

i'll be DAMNED if some jackass is going to tell me i cant. so if i get a ticket for it(i RARELY do it tho) i will be fighting it. and until THEY pay my mortgage, i'll do as I please....

or so i say..until i get hit with some multi thousand dollar fine:(

Over a period of just 4 years, the late fees and interest have turned that ticket into $2,600 in total fines. And before you say, "That's OUTRAGEOUS, I wouldn't pay no $2,600 for a fucking parking ticket, that's cruel and unusual", it gets worse. When he refused to pay $2,600 for a $50 parking ticket, the city TOOK his $245,000 house, HOA-style, and said "Okay, now we're even, you don't have to pay us anymore."

This is why I say "I don't know why you guys are so surprised to hear about this". Governments and civil bodies are two things that should always have the least amount of power physically necissary to still do their basic duties. When people say, "A government big enough to supply for your needs is powerful enough to take everything you have", they really mean it.

So your argument is what? That you don't like what they're doing on their own property so they shouldn't be allowed to do it on their own property?

Truth be told... we has a society tend to forget about others... You seem to not care about how what you do effects others... (Actually kind of selfish) while we're worried about ourselves as well, but we know we have to help you keep your place clean because you won't do it without us...

Doesn't it bother anyone here that someone else has to tell you to clean your room, someone else has to tell you to wash your car, mow your lawn, trim your trees... Somethings should have been learned as kids, but sadly they weren't (i'm not directing this at you, I'm directing it at everyone who DOES those things)

Let me say this.. I wish HOA's didn't need to be around, but too many people out their leave a mess and don't plan on ever cleaning it up.. Broken down cars in their driveway on blocks, weeds growing on the sidewalk, dead trees, etc...
How is that YOUR problem? Why do you feel the need to tell them they have to take care of their property and make it look nice? It's THEIR property.

I was exaggerating. I'm not sure if you've ever heard of it, it can be tricky sometimes.

As for police, their job is to protect us from others who are committing criminal acts which might harm us, not "from ourselves".

If you get the time, read "We the Living" by Ayn Rand, maybe you'll understand where I'm coming from.

No, I can assure you neither myself nor monstermack are forgetting about that. I sure as fuck didn't vote for it, and if it was something we could vote out I sure as fuck would. There, now there's no confusion. lol
